These Terms of Service govern the use of the Formanelkuliter online store and the purchase of products through our website.
By placing an order through our online store, you confirm that you have read and accepted these Terms of Service.

2. Our Products
Formanelkuliter offers handmade sculptures created from natural materials.
Our collection includes sculptures made from:
• natural stone;
• clay; and
• wood.
The products available through the online store are ready-made works. We do not currently offer custom-made or personalised sculptures.
Because our products are handmade and may incorporate natural materials, individual pieces may have natural variations in texture, colour, surface, grain, shape, and other visual characteristics.
These variations may be an inherent part of the material and artistic production process and do not, by themselves, constitute a defect.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, materials, prices, and other information displayed in the online store are accurate and up to date.
The appearance and colours of products may vary slightly depending on the customer's screen, device settings, lighting conditions, and the natural characteristics of the materials used.
If a product does not correspond to its description, agreed characteristics, or applicable legal requirements, the consumer's statutory rights remain unaffected.
4. Prices and VAT
The prices displayed in our online store include applicable VAT unless explicitly stated otherwise.
Prices may be displayed in different currencies depending on the customer's location, including:
• Hungarian Forint (HUF) for Hungary;
• Euro (EUR) for European countries; and
• US Dollar (USD) for Ukraine.
The applicable price and currency will be displayed during the checkout process before the order is completed.
Shipping costs, where applicable, are shown separately.
5. Placing an Order
To place an order, the customer selects the desired product, adds it to the shopping cart, provides the required information, selects an available payment method, and submits the order through the checkout process.
Before completing the order, the customer has the opportunity to review and correct the information provided.
The customer is responsible for ensuring that all information submitted during the ordering process is accurate and complete.
6. Payment
Payment methods available through the online store may include Visa, Mastercard, and other payment methods made available through Shopify.
Payment must be successfully authorised for the order to be processed, unless otherwise agreed.
Payment processing is handled through Shopify and the relevant payment service providers integrated into the Shopify platform.
7. Formation of the Contract
An order submitted through the online store constitutes an offer by the customer to purchase the selected product under the conditions displayed at the time of ordering.
The sales contract is formed upon acceptance of the order by the seller in accordance with applicable law.
An automated email confirming receipt of an order does not necessarily constitute acceptance of the order where applicable law requires a separate acceptance.
If we are unable to fulfil an order, we will inform the customer as soon as reasonably possible and handle any payment already made in accordance with applicable law.
8. Product Availability
Our sculptures are sold subject to availability.
If a product displayed as available becomes unavailable before the order can be fulfilled, we will inform the customer as soon as reasonably possible.
If the customer has already paid for a product that cannot be supplied, the relevant amount will be refunded in accordance with applicable law.
9. Shipping
We deliver orders to Hungary, European countries, and Ukraine.
Orders are delivered using the seller's own delivery service.
Detailed information regarding delivery times, shipping fees, delivery areas, and other shipping conditions is provided in our Shipping Policy.
Estimated delivery times may be affected by circumstances outside our reasonable control.
10. Customer Responsibilities
The customer is responsible for:
• providing accurate billing, delivery, and contact information;
• ensuring that the delivery address is suitable for receiving the order;
• inspecting the product after delivery where appropriate;
• handling and using the sculpture appropriately; and
• complying with applicable laws and import requirements in the destination country.
The customer is responsible for damage caused by improper handling, misuse, modification, unsuitable storage, or other actions attributable to the customer after receiving the product.
Nothing in these Terms limits mandatory consumer rights that cannot legally be excluded or restricted.
11. Right of Withdrawal
Consumers purchasing online within the European Union generally have a 14-day right of withdrawal without giving a reason, subject to applicable law and statutory exceptions.
Detailed information regarding the exercise of the right of withdrawal, returns, refunds, and exchanges is provided in our Return & Refund Policy.
The right of withdrawal does not affect any other statutory rights available to consumers.
12. Defective or Non-Conforming Products
If a product is defective, arrives damaged, or otherwise does not conform to the sales contract, the customer may have statutory rights and remedies under applicable consumer protection laws.
Depending on the circumstances and applicable legal requirements, these remedies may include repair, replacement, a price reduction, or a refund.

We will make reasonable efforts to investigate and resolve complaints in accordance with applicable law.
14. Consumer Dispute Resolution
We encourage customers to contact us directly before initiating an external dispute resolution procedure.
Consumers may have the right to contact the competent Hungarian conciliation body or another consumer dispute resolution body available under applicable law.
Nothing in these Terms prevents a consumer from exercising their right to contact the competent consumer protection authority or dispute resolution body.
15. Intellectual Property
All content available on the Formanelkuliter website, including photographs, product images, texts, graphics, logos, designs, and other materials, is protected by applicable intellectual property laws unless otherwise stated.
Unauthorised copying, reproduction, distribution, modification, publication, or commercial use of website content is prohibited unless permitted by law or authorised in writing by the relevant rights holder.
16. Use of the Website
The website may only be used for lawful purposes.
Users must not:
• interfere with the operation or security of the website;
• attempt unauthorised access to systems or data;
• introduce malicious or harmful code;
• use the website for fraudulent purposes; or
• reproduce or commercially exploit website content without permission.
We reserve the right to restrict or suspend access to the website where reasonably necessary to protect our business, website, systems, or other users, subject to applicable law.
17. Limitation of Liability
We are responsible for fulfilling our contractual and statutory obligations in accordance with applicable law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, these Terms do not exclude or restrict mandatory consumer rights or liability that cannot legally be excluded or limited.
18. Force Majeure
We are not responsible for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, significant transportation disruptions, government actions, war, civil disturbances, strikes, or other extraordinary events.
In such circumstances, we will take reasonable steps to minimise the impact and resume performance as soon as reasonably possible.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, website, services, or applicable laws.
The version of the Terms applicable to an order will generally be the version available and accepted at the time the order was placed, subject to mandatory applicable law.
The current version of these Terms will remain available through our online store.
20. Governing Law
These Terms are governed by the law applicable to the contractual relationship, including applicable Hungarian law and mandatory consumer protection provisions of European Union law.
Where mandatory provisions of the law of the consumer's country of habitual residence provide additional protection, such mandatory provisions remain unaffected.
Nothing in these Terms prevents consumers from exercising rights granted to them under applicable mandatory law.
21. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
